Operation of the Magistrate Office

How the Magistrate Office is to Run:
 1) Most complaints will be handled by a simple quick "curb-side justice" by a Magistrate hearing. Only truly serious criminal charges need a trial - espionage, murder, etc. Magistrate summons those required as witnesses, listens and rules.
 The process of appeal is from magistrate to chief magistrate to high magistrate to Ubar/Admin, but if you are dead it is hard to appeal. The head/chief scribe can not change a magistrates decisions only a higher ranked magistrate and finally the Ubar/Admin of the city may, though in my experience the Ubar/Admin did not over rule the high magistrate wanting to stay out of disputes.
 2) The scarlets are also under the cities laws, not above them. They serve arrest warrants and bring prisoners in for trial, they do NOT render their own judgment and punishment (except in time of battle/raiders just kill attacking warriors, no trial)
 3) Regarding the collaring of a free woman. Actual collaring of free woman can only be ordered by high magistrate, if no high magistrate then by a magistrate of the city. A free citizen can drag a women to a magistrate, but cannot simply collar and strip her, especially not the women of the village. If there is a question about if the woman is free she shall be treated as a free woman and put under house arrest in the city until a free woman of the city can determine if she is branded or not.
 4) If visitors from a city we are allied with, they have the same rights as our citizens. If from other cities, do they have the same rights but on a very short leash. Visitors need to keep their behavior clean and above reproach.
 5) Notice of incident/hearing are to be posted/publish so folks know hearings are occurring and the decision in each.
 6) The highest magistrate of the city is a full member of the high council with all the rights and privilege of the council (example: voting). This will facilitate keeping the magistrates and high council having the same understanding of the laws and desires of the council.

Process for Opening the Magistrate Office in the City:
 a) Meet with high council to confirm that scarlets are under city law and agreement of the above.
 b) Issue a notice to the citizens listing who is the active magistrates are including a brief description of who to see about what and where they will be able to view postings from the magistrate office.

 If you are break the law or have a disputes do the following:

•If one citizen or those not of the city is accused of breaking the last they are to be brought to a magistrate for judgment and punishment if necessary.
•If the disputes involving more than one citizens of the same caste go to the head of their own caste for judgment in the matter, then notify the highest magistrate of their decision and what if any punishment is given.
•If the disputes involving citizens of more than one caste then go to a magistrate for judgment in the matter.
•The process of appeal is from magistrate, to chief magistrate, to high magistrate, then to Ubar/Admin, but if you are dead it is hard to appeal.

Meeting with Village of Rorus Heads

[17:03] Kati Beattie (kati.evans): 3) in all my experiences as a magistrate, the single most common issue was the collaring of a free woman. the laws need to be very clear about that, and the actual collaring ordered by a magistrate only. a free citizen can drag a women to a magistrate, but cannot simply collar and strip her.
Rest (Restless Twist): those are by far the biggest 3 things

[17:04] Kati Beattie (kati.evans): #4 is a little more complex but very important and necessary to avoid confrontations and misunderstandings, what are the rights of visiting free inside this village? if visitors from a city we are allied with, they should have the same rights as our citizens. if from other cities, they have the same rights but on a very short leash, they need to keep their behavior clean and above reproach

[17:15] Çassian イhalassa (gaiuscassian): It's not an easy job, and certainly doesn't always go smoothly. People won't always cooperate, and will certainly not always act like adults. You will get "defamation and slander" suits filed that are neither and more of a pissing contest
[17:16] Kerok Himura (keith.chrome): it is always best to ask when your unsure. You will find that when we give someone a job we pretty much let them run it.. We may give a task but the actual running is yours

PROCESS FOR ACTIVATING MAGISTRATES / JUSTICE IN RORUS:

Rest (Restless Twist): to get things going in this city, i would suggest the following ... in this sequence....

Rest (Restless Twist): a) meet with nikki and commander (Kerok and Cassian)  to confirm that scarlets are under city law.

Rest (Restless Twist): b) prepare and issue a notice to the citizens listing who the magistrates and advocates are (and where that list can ve viewed on an ongoing basis)

Rest (Restless Twist): c) state in that notice that the legal system is active and ready for business, highlighting that most disputes should be brought to a magistrate for a quick hearing and judgment

Rest (Restless Twist): c') if a caste member breaks caste law, rather than village law, we will turn the offenders over to the Head-Of-Caste, and expect then to notify Magistrates of their decision and punishment

Rest (Restless Twist): d) upon each and every hearing, publish the result so folks know hearings are happening, and what was decided at each.  That requires Rorus notice ability
